Workplace Injuries
Employees injured in a work related accident do not have to establish that the employer or another employee was negligent. The Workers’ Compensation Act provides for a recovery of an employee injury regardless of fault. Therefore, even if an employee is injured because of his own fault, the employee is entitled to medical treatment, temporary disability and permanent disability.
There are separate courts that adjudicate workers’ compensation claims. There are statutory laws that must be followed and there are compensation charts that evaluate the permanency of a particular injury.
