Assisted Living Facilities: Neglect and Abuse, NJ
Assisted living facilities are not nursing homes and do provide nursing home care. Assisted living facilities are for the elderly who need assistance with activities of daily living. Assisted living facilities are not subject to OBRA regulations.
Assisted living facilities are regulated by the State of New Jersey. These regulations address the care to be given. The regulations contain a Bill of Rights similar to the Nursing Home Bill of Rights. The staffing requirements are less than in nursing homes.
One of the main issues with assisted living is whether the resident is appropriate for assisted living or in reality needs nursing home care. A resident is evaluated before being accepted into an assisted living facility. An assisted living facility should not accept a resident who needs more care than is available. For instance, if the resident has a high incidence of falls, is combative, has certain conditions, the assisted living facility should acknowledge that residency in its facility is not appropriate.
