Doctors have the duty to treat patients in accordance with standard of care acceptable to like persons in the profession. In order to pursue a medical malpractice case, an affidavit of merit must be filed signed by a doctor attesting that there has been a deviation for accepted standards of practice causing the injury. In medical malpractice cases, expert testimony is required to establish what specific conduct deviated from acceptable standards and as a result an injury was sustained.

Medical malpractice cases take on many forms such as failure to diagnose, failure to treat, misdiagnosis, surgical errors etc… As a result of medical malpractice, the patient can sustain disabling injuries, pain, suffering and death.
