Charitable Immunity Bars Claim Against College For Student Death From Fall Caused By Alcohol Intoxication
- On December 29, 2009, the Appellate Division found that a college is immune from liability for the accidental death of an intoxicated student who fell to his death from his fourth floor dormitory window. The Court held that New Jersey’s Charitable Immunity Act, N.J. S.A. 2A: 53-7 et. seq., grants immunity to a college for students, while living in a dormitory, because the student was receiving the benefits of the schools educational works. (Orzech et. als. v.
